The Alaska Constitution Party opposes Resolution HJR13’s calling for an Article V Convention of the States for the purpose of proposing amendments to the United States Constitution.
We AGREE with lines 7 – 9, that “the drafters of the Constitution of the United States empowered state legislators to be guardians of liberty against future abuses of power by the federal government.”
We also AGREE that it is obvious that elected officials have abused the power entrusted to them by the people they represent.
We DISAGREE with the premise that unlimited terms of service is the cause of such abuse. Abuse of power can occur without regard to time in office.
We AGREE that the framers of the original Constitution provided an Article V convention as a means to amend the Constitution in times of extreme duress in the nation.
We STATE that the framers also provided for a single amendment process, which has been successfully implemented in our nation’s past and we see no reason why a term limit Amendment cannot not be proposed using this less intrusive process.
We STATE that the concept of a limited Article V Convention is a false hope. Many Constitution Party members, including the state chairman of the Alaska Constitution Party, have attended Constitution Convention simulations at the University level or through private organizations in several states over the past two decades. It is obvious that, even when operating under strict Robert’s Rules of Order and convention rules, proposals to open up the convention to any and all amendment considerations, can and will occur.
We are also concerned that, given the current polarization of our beloved constitutional Republic, an Article V Convention at this time will lead to even more civil unrest in our streets no matter which way the pendulum of change may swing. This would be paramount to using the Constitution to violate one of its own basic tenets of good governance, that of insuring “Domestic Tranquility”.
We will continue to oppose an Article V Convention but will also support the right of the state legislatures to call upon Congress to propose single issue amendments which have been successfully used in the past.
